Art.1 – Purpose

  • These general terms and conditions of sale exclusively govern the rights and obligations of the parties arising from the online sale of products offered on the website and the relationships established through the Internet.
  • These terms apply to online sales within the European territory, to the exclusion of any other document, whether the buyer is a professional or a consumer.
  • Purchasing goods or services through this website implies the buyer's unconditional acceptance of these terms and conditions of sale.
  • Sales may be concluded in English and French.

Art. 2 – Products/Prices

  • Products: the products offered for sale by the seller are those displayed on the website at the time the user visits it, subject to availability.
    • Each product is accompanied by a description provided by the supplier.
    • Catalogue photographs are as accurate as possible but cannot guarantee a perfect match with the product offered, particularly with regard to colours. These products and services are offered subject to availability. If, despite the seller's efforts, some or all items are unavailable, the seller will inform the buyer by email as soon as possible and offer the choice of waiting or cancelling the unavailable items free of charge. Available items will be delivered as usual.
  • Prices: prices are stated in euros and apply in all countries within the euro area. They include any applicable discounts and VAT in force on the date of the order. The applicable prices are those in force when the order is confirmed.
  • Shipping costs are calculated according to the total weight in kilograms of the items in the shopping cart.

Art. 3 – Order Registration and Confirmation

  • Buyers wishing to purchase a product or service must:
    • Complete the identification form by providing all requested details or enter their customer number if they have one.
    • Complete the online order form by providing all references for the selected products or services.
    • Validate their order after checking it.
    • Make payment under the specified conditions.
    • Confirm their order and payment.
  • Confirmation of the order constitutes acceptance of these terms and conditions of sale, acknowledgement that the buyer has read and understood them, and a waiver of the buyer's own purchasing terms or any other conditions.
  • All information provided and the recorded confirmation shall constitute proof of the transaction. The confirmation shall constitute a signature and acceptance of the transactions carried out.
  • The seller will send an email confirming receipt of the order.

Art. 4 – Delivery

  • For all available items, the delivery time is 1–2 calendar days (working days), starting on the day following receipt of the bank transfer for the order.
  • The products ordered by the buyer will be delivered to the address provided on the order form, which must be within the agreed geographical area.
  • The goods are transported at the seller's risk until they are delivered to the address specified by the buyer. From that point onwards, the buyer assumes the risk.
  • Delivery times are provided for information purposes only. If delivery exceeds thirty days from the order date, the sales contract may be terminated and the buyer refunded.

Art. 5 – Right of Withdrawal

  • Consumers have fourteen calendar days to return the product(s) they ordered at their own expense, without penalty and without giving a reason. This period begins on the day following delivery of the order.
  • For goods delivered in successive shipments, the withdrawal period begins on the day following the first delivery.
  • This right of withdrawal does not apply to professional buyers.
  • If the above conditions are met, the buyer will be refunded any amounts paid within thirty days of exercising the right of withdrawal.
  • The buyer has no right of withdrawal for contracts involving goods made to the buyer's specifications or clearly personalised, goods which by their nature cannot be returned or are liable to deteriorate or expire rapidly, unsealed audio or video recordings or computer software, or the supply of newspapers, periodicals and magazines.

Art. 6 – Payment

  • Every order entails a contribution towards shipping costs, unless delivery is free of charge, as described in Art. 2. The only accepted payment method is bank transfer.
  • Once the order has been validated on our website, the buyer will receive an email containing the bank details required for payment. Payment must then be made in accordance with the arrangements agreed with the buyer's bank.
  • The ordered items remain our exclusive property until the buyer has paid for the order in full.

Art. 7 – Warranty

  • The distributor, Invaders Amplification – Rue Cherave 95 – 4500 Huy – Belgium, acting as guarantor, provides a warranty covering defects in materials or workmanship for a period of two years from the date of purchase (purchase invoice from a retailer or directly from the manufacturer), in accordance with these warranty terms and for the first owner. The warranty period begins on the date of the customer's invoice.
  • The buyer must retain the delivery note/invoice. If an item is unsuitable, the buyer has fourteen days to return it, provided it is in the same condition as when dispatched.
  • The buyer benefits from the statutory legal guarantee for any lack of conformity existing at the time of delivery, provided the buyer was unaware and could not reasonably have been expected to be aware of the defect when the contract was concluded, and the defect becomes apparent within two years of delivery.
  • In such cases, the buyer may request repair or replacement of the item. If neither option is possible, the buyer may request an appropriate price reduction or termination of the contract, under the conditions provided by law (Articles 1649 bis et seq. of the Belgian Civil Code). To do so, the buyer must notify the seller in writing no later than two months after discovering the defect. If the defect appears within six months of delivery, the seller is, in principle, responsible for proving that the defect did not exist at the time of delivery.
  • After the two-year period, the buyer can no longer demand repair or replacement of the item. Order preparation and shipping costs, as well as handling fees, remain payable if the buyer exercises the right to return all or part of the order.

What our warranty covers:

  • A three-month warranty applies to consumables (tubes, bulbs, fuses and speakers).
  • The warranty covers the repair of defects in materials or workmanship free of charge. The guarantor reserves the right to repair or replace the product.
  • All replaced parts become the property of the guarantor without exception.
  • The product must, without exception, be submitted exclusively to the retailer from whom it was purchased, as that retailer is solely responsible for the sales process. If this is not possible, the customer must submit the warranty claim to a retailer in the country where the product was purchased. In the latter case, Invaders Amplification may be contacted directly.
  • Under this warranty, the guarantor assumes no other liability and shall not be liable for any loss of income or profits resulting from the use or malfunction of the product.
  • If, during an inspection, the retailer, distributor or guarantor determines that the defect is not covered by the warranty or that the warranty period has expired, the customer is responsible for the inspection and repair costs.
  • Shipping costs from the customer to the authorised retailer, distributor or guarantor cannot be covered. If a warranty claim is valid, shipping costs (outbound and return) will be covered by Invaders Amplification only for shipments to or from the distributor, seller or buyer in the country where the purchase was made. Otherwise, return shipping costs will not be covered by Invaders Amplification. Invaders Amplification will endeavour to find the most suitable return solution.

Art. 8 – Privacy and the Processing of Personal Data

  • Providing personal information collected as part of distance selling is mandatory, as this information is necessary to process and deliver orders and issue invoices. This information is strictly confidential. Failure to provide the required information will automatically result in rejection of the order. The buyer may access and request correction of this data at any time by sending a letter or email accompanied by a photocopy of both sides of their identity card. Further information concerning privacy and the processing of personal data may be obtained from the Belgian Data Protection Commission, Rue Haute 139 B, 1000 Brussels.

Art. 9 – Intellectual Property

  • All elements of the seller's website remain the exclusive intellectual property of the seller. No one is authorised to reproduce, exploit, redistribute or use any element of the website, even partially, whether software, visual or audio content. Any direct or hypertext link is strictly prohibited without the seller's express prior written consent.

Art. 10 – Miscellaneous

  1. Force Majeure: the seller shall not be liable for total or partial failure to perform its obligations under this contract where such failure is caused by an event constituting force majeure, including computer viruses, total or partial disruption or strikes affecting postal services, transport and/or communications, flooding, fire, pandemics, etc.

Events meeting the criteria established by case law shall be considered cases of force majeure.

  1. Partial Invalidity: if one or more provisions of these general terms and conditions of sale are deemed invalid or declared invalid under a law or regulation, or following a final decision by a competent court, all other provisions shall remain valid.
  2. Entire Agreement: these general terms and conditions of sale and the order summary sent to the buyer form a contractual whole and constitute the entirety of the contractual relationship between the parties. In the event of any contradiction between these documents, the general terms and conditions of sale shall prevail.
  3. Applicable Law – Competent Courts: these general terms and conditions of sale and the contractual relationship between the seller and the buyer are governed by Belgian law. In the event of a dispute, only the courts of the judicial district in which the seller's registered office is located shall have jurisdiction, subject to any mandatory public-order provisions.

Any order for a product offered on the website implies that the buyer has read and expressly accepted these general terms and conditions of sale.
